Admittedly, and as the Court held, in substance, in paragraphs 17 to 21 of the Titanium dioxide case, cited above, recourse to a dual legal basis is not possible where the procedures laid down for each legal basis are incompatible with each other or where the use of two legal bases is liable to undermine the rights of the Parliament (see also, to that effect, Joined Cases C-164/97 and C‑165/97 Parliament v Council [1999] ECR I-1139, paragraph 14, and Case C‑338/01 Commission v Council, cited above, paragraph 57).
52 Zwar ist, wie der Gerichtshof in den Randnummern 17 bis 21 seines Urteils Titandioxid im Wesentlichen ausgeführt hat, der Rückgriff auf eine doppelte Rechtsgrundlage ausgeschlossen, wenn sich die für die beiden Rechtsgrundlagen jeweils vorgesehenen Verfahren nicht miteinander vereinbaren lassen und/oder wenn die Verbindung der Rechtsgrundlagen die Rechte des Parlaments beeinträchtigen würde (vgl. in diesem Sinne auch Urteile vom 25. Februar 1999 in den Rechtssachen C‑164/97 und C‑165/97, Parlament/Rat, Slg. 1999, I‑1139, Randnr. 14, und vom 29. April 2004, Kommission/Rat, Randnr. 57).
