the aid scheme does not apply to undertakings active in the primary production of agricultural products ; it may apply to undertakings active in the processing and marketing of agricultural products unless the amount of the aid is fixed on the basis of the price or quantity of such products purchased from primary producers or put on the market by the undertakings concerned, or the aid is conditional on being partly or entirely passed on to primary producers.
Die Beihilferegelung gilt nicht für Unternehmen, die in der Primärproduktion landwirtschaftlicher Erzeugnisse tätig sind. Sie kann für Unternehmen der Verarbeitung und Vermarktung von Agrarerzeugnissen gelten, es sei denn, die Höhe der Beihilfe wird nach Maßgabe des Preises oder der Menge dieser Erzeugnisse bestimmt, die beim Primärerzeuger gekauft oder von den betreffenden Unternehmen auf den Markt gebracht werden, oder die Beihilfe wird nur dann gewährt, wenn sie teilweise oder ganz an die Primärerzeuger weitergegeben wird.
