These difficulties are due to the significant differences at present between private international law systems and the Member States’ substantive law, which create obstacles to the exercise of freedom of movement and the enjoyment of the right to own property. We should not forget that the latter is a general principle of law (Court of Justice, Case C-368/96, Generics (UK) and others, [1998] ECR I-7967, point 79, and the case law cited therein) and is also included among the fundamental rights enshrined in the Nice Charter.
Diese Schwierigkeiten ergeben sich aus den großen Unterschieden zwischen den Systemen des internationalen Privatrechts und des materiellen Rechts der Mitgliedstaaten, die das Recht auf Ausübung der Freizügigkeit sowie das Recht auf Eigentum behindern, das allgemeiner Rechtsgrundsatz ist (Gerichtshof, Rechtssache C-368/96, Generics [UK] u. a., Slg.1998, I-7967, Randnr. 79, und die dort zitierte Rechtsprechung) und zu den Grundrechten der Charta von Nizza gehört.
