Als Flüchtling gilt gemäß der Genfer Konvention von 1951 über den Flüchtlingsstatus eine Person, die "aus der begründeten Furcht vor Verfolgung wegen ihrer Rasse, Religion, Nationalität, Zugehörigkeit zu einer bestimmten sozialen Gruppe oder wegen ihrer politischen Überzeugung sich außerhalb des Landes befindet, dessen Staatsangehörigkeit sie besitzt, und den Schutz dieses Landes nicht in Anspruch nehmen kann oder wegen dieser Befürchtungen nicht in Anspruch nehmen will..".
In accordance with the 1951 Geneva Convention relating to the Status of Refugees, a refugee is a person "who owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group, or political opinion, is outside the country of his nationality, and is unable to or, owing to such fear, is unwilling to avail himself of the protection of that country..".
