Die Kommission führte in ihrer Antwort aus (H-0024/01), dass sie die Auffassung vertritt, dass die Einführung einer allgemeinen Steuer in der Form, wie ursprünglich von Professor Tobin vorgesehen (die sogen. Tobin-Steuer), durch einen Mitgliedstaat Artikel 56 und den Artikeln 12, 39, 43 und 49 sowie den Bestimmungen des EWR-Abkommens widerspricht, und dass eine solche Steuer, wenn sie auf Gemeinschaftsebene eingeführt würde, kaum mit Artikel 57 Absatz 2 des EG-Vertrags vereinbar wäre, da dieser Artikel die Möglichkeit festschreibt, restriktive Maßnahmen nur in einer bestimmten Anzahl von Bereichen zu ergreifen.
The Commission replied (H-0024/01) that it was of the opinion that a tax of general application as originally conceived by Professor Tobin ('Tobin tax'), if introduced by a Member State, was likely to be contrary to Article 56, together with Articles 12, 39, 43, 49 and the corresponding articles of the EEA Agreement and that such a tax, if introduced at Community level, was also unlikely to be possible under Article 57(2) of the EC Treaty, since that article provided for restrictive measures only in a limited number of areas.
