The Appeal Court, Trento, before which he appealed, asks the Court of Justice whether the Directive on the return of illegally staying third-country nationals (‘the Directive on return’) 1 precludes national rules which provide for a prison sentence to be imposed on an illegally staying foreign national on the sole ground that he remains, without valid grounds, on the national territory, contrary to an order to leave that territory within a given period.
Die Corte d’appello di Trento, bei der er Berufung eingelegt hat, möchte vom Gerichtshof wissen, ob die Richtlinie über die Rückführung illegal aufhältiger Drittstaatsangehöriger („Rückführungsrichtlinie“) einer nationalen Regelung entgegensteht, die vorsieht, dass gegen einen Ausländer, der sich illegal im Inland aufhält, allein deshalb eine Haftstrafe verhängt werden kann, weil er entgegen einer Anordnung, das Staatsgebiet innerhalb einer bestimmten Frist zu verlassen, ohne berechtigten Grund in diesem Gebiet bleibt.
