The first two questions concern procedural matters, namely (i) whether, when it re-examines the situation of the person concerned at the end of an initial period of detention, the competent administrative authority must adopt a measure in writing with reasons being given in fact and in law and (ii) whether the review of the legality of such a measure requires that the court having jurisdiction be able to give a decision on the merits of the case.
Die ersten beiden Fragen, die verfahrensrechtlicher Natur sind, gehen dahin, (1) ob die zuständige Verwaltungsbehörde, wenn sie die Situation des Betroffenen am Ende des ersten Haftzeitraums prüft, eine schriftliche Maßnahme erlassen muss, in der ihre rechtlichen und tatsächlichen Gründe angegeben sind, und (2) ob es die Prüfung der Rechtmäßigkeit einer solchen Maßnahme erfordert, dass das zuständige Gericht den Fall in der Sache entscheiden kann.
