The Višje sodišče v Mariboru (Court of Appeal, Maribor), to which Mr Sgueglia appealed, asked the Court of Justice whether a court of the Member State in whose territory the child is present can take a provisional measure giving custody of a child to one parent, where a court of another Member State has already delivered a judgment provisionally granting custody of the child to the other parent, and that judgment has been declared enforceable in the former Member State.
Das Višje sodišče v Mariboru (Obergericht Maribor) (Slowenien), bei dem Herr Sguelgia ein Rechtsmittel einlegte, hat den Gerichtshof gefragt, ob das Gericht des Mitgliedstaats, in dessen Hoheitsgebiet sich das Kind befindet, eine einstweilige Maßnahme erlassen kann, die darauf abzielt, das Sorgerecht für das Kind einem Elternteil zuzusprechen, wenn ein Gericht eines anderen Mitgliedstaats bereits eine Entscheidung erlassen hat, mit der das Sorgerecht für das Kind vorläufig auf den anderen Elternteil übertragen worden ist, und diese Entscheidung im erstgenannten Mitgliedstaat für vollstreckbar erklärt wurde.
