Member State which applies, in accordance with the third subparagraph of Article 2(2) of that Directive, lower excise duties than those resulting from the provisions of the first

„(3) Unbeschadet von Artikel 32 können die Mitgliedstaaten, die im dritten Unterabsatz von Artikel 2 Absatz 2 der Richtlinie 92/79/EWG nicht aufgeführt sind, ab dem 1. Januar 2014 für Zigaretten, die ohne zusätzliche Zahlung von Verbrauchsteuern aus einem Mitgliedstaat, der gemäß Artikel 2 Absatz 2 Unterabsatz 3 dieser Richtlinie niedrigere als die Verbrauchsteuern nach Artikel 2 Absatz 2 Unterabsatz 1 anwendet, in ihr Gebiet eingeführt werden, eine Mengenbeschränkung von mindestens 300 Zigaretten verhängen.
