Accordingly, whilst there were three possible categories of candidates, namely, those who were EU officials, those who had already been recruited to the EEAS as temporary staff within the meaning of Article 2(e) of the CEOS and those who, like the applicant, did not come within either of those categories, the vacancy notice provided that the successful candidate would, in the case of an EU official, be recruited at his existing grade and, in the case of the others, that is to say staff from the national diplomatic services of the Member States, at grade AD 5.
Während es also drei Kategorien von möglichen Bewerbern gab, nämlich jene, die Beamte der Europäischen Union waren, jene, die bereits vom EAD als Bedienstete auf Zeit gemäß Art. 2 Buchst. e der BBSB eingestellt waren, und jene, die, wie der Kläger, weder in die eine noch in die andere dieser Kategorien fielen, sah die Stellenausschreibung für die Einstufung der Bewerber in eine Besoldungsgruppe vor, dass die Beamten der Union ihre Besoldungsgruppe behalten und die anderen, also das Personal aus den nationalen diplomatischen Diensten der Mitgliedstaaten, in die Besoldungsgruppe AD 5 eingestuft werden sollten.
