Regarding the proportionality of the amount of the fine, the Court notes, in particular, in addition to the characteristics of the infringement, first, that the amount of the fine, although high, is at the lower end of the range of amounts that could have been imposed and, secondly, that it does not seem disproportionate in relation to the objective pursued of protection of the system of notification and prior approval of concentrations.
Im Übrigen durfte die Kommission nach Ansicht des Gerichts davon ausgehen, dass die Tatsache, dass die Zuwiderhandlung fahrlässig begangen worden war, nicht zu einer Herabsetzung der Geldbuße führen musste. In Bezug auf die Verhältnismäßigkeit ihres Betrags berücksichtigt das Gericht neben den Merkmalen der Zuwiderhandlung insbesondere die Tatsache, dass sich der genannte Betrag, obgleich er hoch ist, am unteren Ende der in Betracht kommenden Bandbreite befindet, sowie den Umstand, dass er nicht außer Verhältnis zum angestrebten Ziel des Schutzes des Systems der Anmeldung und vorherigen Genehmigung von Zusammenschlüssen steht.
