Thus, the Court points out that, in the light of the freedoms of movement, it has not accepted – as it has already stated in the context of the sale of non-prescription medicines and contact lenses – arguments relating to the need to provide individual advice to the customer and to ensure his protection against the incorrect use of products, put forward to justify a ban on internet sales. Similarly, the Court rules that the need to maintain the prestigious image of PFDC's products is not a legitimate aim for restricting competition.
Dabei hebt der Gerichtshof hervor, dass er bereits im Kontext des Verkaufs von nicht verschreibungspflichtigen Arzneimitteln und von Kontaktlinsen unter dem Blickwinkel der Verkehrsfreiheiten die Argumente in Bezug auf die Notwendigkeit der individuellen Beratung des Kunden und seines Schutzes vor einer falschen Anwendung der Produkte zurückgewiesen hat, mit denen ein Verbot des Verkaufs über das Internet gerechtfertigt werden sollte. Der Gerichtshof führt ferner aus, dass die Notwendigkeit, den Prestigecharakter der Produkte von PFDC zu schützen, kein legitimes Ziel zur Beschränkung des Wettbewerbs sein kann.
