Die Kúria muss somit klären, ob ein normal informierter und angemessen aufmerksamer Verbraucher aufgrund der Werbung und der Informationen, die der Darlehensgeber im Rahmen der Aushandlung des Darlehensvertrags bereitgestellt hat, nicht nur wissen konnte, dass beim Umtausch einer ausländischen Währung ein Unterschied zwischen dem Verkaufs- und dem Ankaufskurs besteht, sondern auch die Folgen der Anwendung des Verkaufskurses für seine Tilgungszahlungen und die Gesamtkosten seines Darlehens einschätzen konnte.
