The rapporteur states that ‘there is no doubt that . halting immigration must be superseded’ on the basis, on the one hand of the ‘Treaty of Amsterdam, which confers competence on the Community in the areas of asylum and immigration’, and on the other, on what she calls ‘actual necessity’.
Wie der Berichterstatter feststellt, steht „außer Frage, dass der [...] Einwanderungsstopp [...] abgelöst werden muss“. Grundlage dafür sei nicht nur der „Vertrag von Amsterdam, der die Zuständigkeit der Gemeinschaft in den Bereichen Asyl und Einwanderung festschreibt“, sondern auch das, was sie eine „faktische Notwendigkeit“ nennt.
