Die Delegation des Parlaments ihrerseits war zwar der Ansicht, dass ein Großteil der von den Inspektoren geleisteten Arbeit Aufgabe der Schifffahrtsverwaltung ist und dass diese subsidiär haftbar sein muss, akzeptierte aber, dass die Mitgliedstaaten keine Höchstgrenze für die finanzielle Haftung der Klassifizierungsgesellschaften bei Schäden infolge leichter Fahrlässigkeit bei ihren Inspektionen festlegen müssen, wenn auch in der Annahme, dass, falls sie – die Mitgliedstaaten – eine solche Höchstgrenze festlegen möchten, diese nicht niedriger als 2 bzw. 4 Mio. Euro bei reinen Sachschäden bzw. Personenschäden sein dürfe.
