By contrast, where the advertisement displayed on the internet on the basis of a keyword corresponding to a trade mark with a reputation puts forward an alternative to the goods or services of the proprietor of the trade mark with a reputation – without offering a mere imitation of the goods or services of the proprietor of that trade mark, without causing dilution of the trade mark or detriment to its repute (tarnishment) and without, moreover, adversely affecting the functions of the trade mark – such use falls, as a rule, within the ambit of fair competition in the sector for the goods or services concerned.
Wenn dagegen im Internet anhand eines Schlüsselworts, das einer bekannten Marke entspricht, eine Werbung gezeigt wird, mit der – ohne eine bloße Nachahmung von Waren oder Dienstleistungen des Inhabers dieser Marke anzubieten, ohne diese zu verwässern oder ihre Wertschätzung zu beeinträchtigen (Verunglimpfung) und ohne im Übrigen die Funktionen dieser Marke zu beeinträchtigen – eine Alternative zu den Waren oder Dienstleistungen des Inhabers der bekannten Marke vorgeschlagen wird, fällt eine solche Benutzung grundsätzlich unter einen gesunden und lauteren Wettbewerb im Bereich der fraglichen Waren oder Dienstleistungen.
