Der Gerichtshof hat die Auffassung vertreten, dass, da die Richtlinie 76/308 die Folgen einer Zustellung in einer anderen Sprache als der Amtssprache des ersuchten Mitgliedstaats nicht regelt, „es Sache des nationalen Gerichts [ist], sein nationales Recht anzuwenden, wobei es dafür Sorge zu tragen hat, dass die volle Wirksamkeit des Gemeinschaftsrechts sichergestellt wird.
The Court took the view that in the absence of provisions in Directive 76/308 on the consequences flowing when notification is made in a language other than the language of the requested Member State, ‘it is for the national court to apply national law while taking care to ensure the full effectiveness of Community law, a task which may lead it to interpret a national rule which has been drawn up with only a purely domestic situation in mind in order to apply it to the cross border situation at issue’ This was held to be subject only to the principles of equivalence and effectiveness
